§ 56-80. Violations; enforcement.

  • (a)

    The city manager or his designee may serve or cause to be served upon any person found to be violating any provisions of this division, a written notice of the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in the notice, permanently cease violation. Nothing contained in this section shall be considered a condition precedent to enforcement of any other penalties contained in this Code for violation of any section of this division.

    (b)

    Any violation of any provisions of this division shall constitute a municipal civil infraction, and shall subject any person found responsible for such municipal civil infraction to a civil fine in accordance with section 30-24 of this Code.

    (c)

    Upon default in payment of any civil fine, the city manager or his designee may specially assess the real property upon which the violation occurred, or add the civil fine as a surcharge to the water bill for service to the property upon which the violation occurred.
